2. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts to use ANSAGO. By using the Platform, you represent and warrant that you meet these requirements.
3. Account Registration
To access certain features, you must create an account. You agree to provide accurate, complete, and current information and to keep your account information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
4. Platform Use
ANSAGO is a marketplace that allows users to list, discover, and transact surplus construction materials and equipment. You agree to use the Platform only for lawful purposes and in accordance with these Terms. You may not use the Platform to:
Post false, misleading, or fraudulent information
Violate any laws or regulations
Infringe on the rights of others
Interfere with the security or functionality of the Platform
5. Listings and Content
Sellers are responsible for the accuracy of their listings, including descriptions, quantities, conditions, and pricing. ANSAGO does not verify the accuracy of listings but reserves the right to remove any content that violates these Terms or is deemed inappropriate.
6. Transactions and Payments
Transactions facilitated through ANSAGO are between buyers and sellers. When using our secure payment (escrow) service, funds are held until both parties confirm the pickup and the transaction is complete. ANSAGO reserves the right to charge fees for transactions and services, which will be disclosed on the Platform.
7. Pickup and Logistics
Buyers and sellers are responsible for coordinating pickup or delivery of materials. ANSAGO is not responsible for the transportation, handling, or removal of materials unless explicitly stated in a paid service agreement.
8. User Conduct
You agree to treat all users with respect and professionalism. Harassment, discrimination, spam, or any abusive behavior will not be tolerated and may result in account suspension or termination.
9. Disclaimers
ANSAGO provides the Platform “as is” and “as available.” We do not warrant that the Platform will be uninterrupted, error-free, or free from harmful components. We are not responsible for the quality, safety, legality, or accuracy of materials listed by users.
10. Limitation of Liability
To the fullest extent permitted by law, ANSAGO LLC shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform, including any disputes between buyers and sellers.
11. Indemnification
You agree to indemnify and hold harmless ANSAGO LLC, its affiliates, officers, employees, and agents from any claims, damages, liabilities, or expenses arising from your use of the Platform or violation of these Terms.
12. Termination
We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms. Upon termination, your right to use the Platform will immediately cease.
13. Changes to Terms
ANSAGO may update these Terms from time to time. We will notify users of material changes through the Platform or via email. Continued use of the Platform after changes are posted constitutes acceptance of the new Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law
principles. Any disputes shall be resolved in the state or federal courts located in Collin County, Texas.
